In  a summary judgement  the District Court  ruled in favor of the  Appellees (TENAFLY BOARD OF EDUCATION ) and against Andrew Policastro.  In a previous case initiated by Policastro, when he  challenged  the The Board’s mailbox policy alleging an infringement of his First Amendment Rights, the court ruled against Policastro. In an attempt to revisit the District Court’s conclusion that his “as applied” challenge was moot Policastro deliberately violated the mailbox policy for a second time.
